By accessing or using our Site, creating an account, or placing an order, you agree to be bound by these Terms. These Terms constitute a legally binding agreement between you and BreakTaste under the provisions of the Information Technology Act, 2000 and the Consumer Protection (E-Commerce) Rules, 2020.
If you do not agree with any part of these Terms, you must discontinue use of our services immediately.
2. Eligibility
By using this Site, you represent and warrant that:
You are at least 18 years of age; or
If you are under 18, you are accessing the Site under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
We reserve the right to terminate your membership and refuse to provide you with access to the Site if it is brought to our notice or if it is discovered that you are under the age of 18 years and transacting without supervision.
3. Products and Services (FSSAI & Food Safety)
3.1. Nature of Goods
You acknowledge that the products sold by BreakTaste include perishable food items (such as cakes, fast food, and beverages) which have a limited shelf life.
3.2. Visual Representation
We make every effort to display the colors, shapes, and appearance of our products accurately. However, actual products may vary slightly from the images shown on the website due to:
Hand-crafted nature of our items.
Screen display settings on your device.
Seasonal availability of ingredients (e.g., fruits used for decoration).
3.3. Allergen Disclaimer
Important Health Notice: While we adhere to strict hygiene standards (FSSAI compliance), our kitchen handles ingredients including, but not limited to, milk, dairy products, nuts (peanuts, walnuts, etc.), gluten (wheat), soy, and chocolate.
It is your responsibility to review the ingredients or contact us before ordering if you have a severe allergy.
BreakTaste is not liable for any allergic reactions resulting from the consumption of our products if the allergen was not disclosed to us or if it falls under standard cross-contamination risks.
4. Orders and Payments
4.1. Order Acceptance
Placement of an order does not guarantee acceptance. We reserve the right to decline or cancel an order for reasons including, but not limited to:
Unavailability of stock/ingredients.
Inability to deliver to your specific location within Sanchore.
Errors in pricing or product information.
4.2. Pricing and Taxes
All prices listed are in Indian Rupees (INR) and are inclusive of applicable taxes (GST), unless stated otherwise. Delivery charges may be calculated separately at checkout.
4.3. Payment Methods
We accept payments via:
Credit/Debit Cards
UPI (Unified Payments Interface)
Net Banking
Cash on Delivery (COD) – Subject to specific value limits or location verification.
5. Cancellation and Refund Policy
Due to the perishable nature of food products, our policies are strict to ensure food safety and reduce wastage.
5.1. Cancellations by Customer
Food Orders: You may cancel your order only within 10 minutes of placing it. Once food preparation has begun, orders cannot be cancelled.
Custom Cakes/Large Orders: Cancellations for custom orders must be made at least 24 hours in advance. Late cancellations may attract a cancellation fee of up to 100% of the order value.
5.2. Returns and Refunds
No Returns: We do not accept returns of food items once delivered due to health and safety regulations.
Refunds: Refunds are only processed under the following strict conditions:
The wrong item was delivered.
The item was completely damaged or spoiled upon arrival (photographic proof required immediately upon delivery).
Items missing from the order.
Refunds will be processed to the original payment source or as store credit within 5-7 business days.
6. Delivery and Shipping
6.1. Service Area
We currently offer delivery services primarily within Sanchore, Rajasthan and specifically designated surrounding areas. Orders placed for locations outside our serviceable radius may be cancelled.
6.2. Delivery Timelines
Estimated delivery times are provided for convenience only.
We are not liable for delays caused by circumstances beyond our control, including but not limited to: traffic congestion, severe weather conditions (e.g., heavy rains), political rallies, or vehicle breakdowns.
6.3. Customer Responsibility
You must ensure that someone is available to receive the order at the delivery address. If a delivery fails because you provided an incorrect address or no one was available, no refund will be issued, and the items will be considered “delivered.”
7. Intellectual Property
All content included on this Site, such as text, graphics, logos (specifically the BreakTaste logo), button icons, images, audio clips, and software, is the property of BreakTaste or its content suppliers and is protected by Indian and international copyright laws.
You may not extract or use parts of the content without express written consent from us.
8. Limitation of Liability
To the fullest extent permitted by law:
BreakTaste shall not be liable for any indirect, incidental, or consequential damages arising out of the use of our products.
Storage: We are not responsible for spoilage or health issues resulting from improper storage of food items by the customer (e.g., failing to refrigerate cakes or dairy items) after delivery has been made.
9. Indemnification
You agree to indemnify and hold harmless BreakTaste, its owners, employees, and affiliates from any claims, damages, or expenses (including legal fees) arising from your breach of these Terms or your violation of any law or the rights of a third party.
10. Governing Law and Jurisdiction
These Terms shall be governed by and constructed in accordance with the laws of India.
Dispute Resolution: Any dispute or difference either in interpretation or otherwise, of any terms of these User Terms between the parties hereto, shall be referred to an independent arbitrator who will be appointed by BreakTaste.
Exclusive Jurisdiction: The courts in Sanchore, Rajasthan shall have exclusive jurisdiction in any proceedings arising out of or in connection with these Terms, to the exclusion of all other courts.
